SERVICE AGREEMENT & TERMS AND CONDITIONS

DANI’S CLEANING

 SERVICE AGREEMENT & TERMS AND CONDITIONS

These Terms and Conditions apply to residential and commercial cleaning services provided by Dani’s Cleaning (“Dani’s Cleaning,” “we,” “us,” or “our”) to the customer (“Client,” “you,” or “your”).

By scheduling, approving, or allowing Dani’s Cleaning to perform services, the Client acknowledges and agrees to these Terms and Conditions.

1. SERVICES

Dani’s Cleaning provides residential and commercial cleaning services according to the service package, estimate, proposal, checklist, or written scope of work agreed upon with the Client.

Services may include, depending on the selected package:

- Standard/Recurring Cleaning

- Deep Cleaning

- Move-In Cleaning

- Move-Out Cleaning

- Residential Cleaning

- Office and Commercial Cleaning

- Add-On Services specifically requested and approved

Only services specifically included in the Client’s selected cleaning package, written estimate, proposal, or scope of work are considered part of the agreed service.

Requests for additional work may result in additional charges.

 2. ESTIMATES AND PRICING

Quotes and estimates are based on information provided by the Client, including property size, condition, number of rooms, type of service requested, frequency, and anticipated level of cleaning.

Dani’s Cleaning reserves the right to adjust the price if:

- The condition of the property is substantially different from what was described;

- The property requires significantly more time or labor than reasonably anticipated;

- Additional areas or services are requested;

- There is excessive buildup, clutter, pet hair, grease, dust, debris, or other conditions requiring additional work;

- Access conditions materially increase the time necessary to complete the service.

Whenever reasonably possible, the Client will be informed before substantial additional work is performed.

3. PAYMENT

Payment is due according to the terms stated in the Client’s estimate, invoice, service agreement, or commercial contract.

Residential services are generally due on or immediately after the date of service unless otherwise agreed in writing.

Commercial clients may be invoiced according to separate written payment terms.

The Client agrees to pay the full agreed service amount unless Dani’s Cleaning authorizes a credit, adjustment, or refund in writing.

A Client may not unilaterally reduce or withhold payment because of a quality concern without first following the Dani’s Cleaning 24-Hour Satisfaction & Re-Clean Policy.

Returned payments, declined payments, late payments, or collection costs may be subject to reasonable fees to the extent permitted by applicable law.

4. ACCESS TO THE PROPERTY

The Client is responsible for providing safe and timely access to the property at the scheduled service time.

Access may be provided through:

- The Client or authorized representative being present;

- A key;

- Lockbox;

- Door code;

- Building access code;

- Concierge or property manager;

- Other pre-arranged method.

If Dani’s Cleaning cannot access the property after arriving for a scheduled appointment, the visit may be treated as a late cancellation or lockout and may be subject to the applicable cancellation fee.

The Client is responsible for providing correct and current access instructions.

5. ARRIVAL WINDOWS

Appointment times may be provided as estimated arrival times or arrival windows.

Traffic, weather, previous appointments, parking conditions, building access, and other circumstances may affect arrival time.

Dani’s Cleaning will make reasonable efforts to notify the Client of significant delays.

Unless specifically agreed in writing, an estimated arrival time is not a guarantee of arrival at an exact minute.

6. CLIENT RESPONSIBILITIES

Before service, the Client agrees to:

- Provide reasonable access to areas to be cleaned;

- Remove excessive clutter when necessary;

- Secure cash, jewelry, medications, firearms, important documents, collectibles, and other valuables;

- Inform Dani’s Cleaning of fragile, damaged, delicate, valuable, antique, custom, or specialty items and surfaces;

- Inform us of surfaces requiring special products or cleaning methods;

- Secure pets when necessary for the safety of the cleaning team;

- Inform us of aggressive animals or other safety concerns;

- Provide working electricity and running water unless otherwise agreed;

- Notify us of alarms, cameras, access systems, construction areas, or hazardous conditions.

Dani’s Cleaning is not responsible for delays or incomplete areas caused by inaccessible spaces, excessive clutter, unsafe conditions, or Client failure to provide necessary access.

7. PETS

Dani’s Cleaning is pet-friendly; however, the Client remains responsible for pets during the service.

Animals that are aggressive, highly anxious, likely to escape, or interfere with the cleaning process should be safely secured before the cleaning team arrives.

Dani’s Cleaning is not responsible for pets that escape or are injured due to the Client’s failure to properly secure them, except where caused by Dani’s Cleaning’s negligence.

 8. SAFETY

Dani’s Cleaning reserves the right to refuse or discontinue work where conditions are unsafe.

Examples may include:

- Aggressive animals;

- Human or animal waste beyond normal household conditions;

- Biohazards;

- Dangerous chemicals;

- Illegal substances;

- Severe mold;

- Pest infestation;

- Unsafe electrical conditions;

- Structural hazards;

- Active construction hazards;

- Unsecured weapons;

- Conditions that create an unreasonable risk of injury.

Refusal to perform unsafe work does not necessarily constitute a service failure.

9. QUALITY CONCERNS

If the Client believes an area included in the agreed scope was not cleaned satisfactorily, the Client must follow the Dani’s Cleaning 24-Hour Satisfaction & Re-Clean Policy.

The Client agrees to provide Dani’s Cleaning a reasonable opportunity to inspect and/or correct the reported issue before requesting a discount, credit, refund, payment reduction, or other adjustment.

10. DAMAGES AND BREAKAGE

The Client must report suspected damage caused during service as soon as reasonably possible.

Dani’s Cleaning may request photographs, receipts, replacement information, inspection, or other reasonable documentation before resolving a damage claim.

Pre-existing damage, normal wear and tear, deterioration, loose fixtures, unstable furniture, improperly installed items, defective materials, and items damaged due to ordinary cleaning pressure may not qualify as damage caused by Dani’s Cleaning.

The Client should notify Dani’s Cleaning before service of unusually fragile, irreplaceable, antique, custom, or high-value items.

11. PRE-EXISTING CONDITIONS

Dani’s Cleaning is not responsible for pre-existing damage or defects.

These may include:

- Scratches;

- Cracks;

- Loose fixtures;

- Broken blinds;

- Peeling paint;

- Deteriorated grout or caulking;

- Rust;

- Hard-water damage;

- Permanent staining;

- Discoloration;

- Damaged flooring;

- Worn finishes;

- Unstable furniture;

- Defective appliances;

- Improperly installed items.

Cleaning may sometimes reveal pre-existing damage that was previously hidden by dirt, dust, grease, or buildup.

12. PHOTOGRAPHS AND DOCUMENTATION

Dani’s Cleaning may take reasonable photographs or videos of work areas for internal documentation, quality assurance, damage documentation, training, or dispute resolution.

Personal or identifying information should be avoided whenever reasonably possible.

Photos or videos will not be used publicly for advertising or social media without separate authorization when such authorization is required.

13. COMMERCIAL CLIENTS

Commercial clients may be subject to additional written terms regarding:

- Service frequency;

- Service schedule;

- Building access;

- Alarm systems;

- Keys and access cards;

- Restricted areas;

- Waste disposal;

- Consumable supplies;

- Janitorial closets;

- After-hours access;

- Security procedures;

- Work orders;

- Purchase orders;

- Insurance requirements;

- Billing schedules.

Where a signed Commercial Cleaning Agreement contains terms different from these general Terms and Conditions, the specific written commercial agreement will control to the extent of the conflict.

14. CHANGES TO SERVICE

The Client should communicate requested service changes before the scheduled appointment whenever possible.

Changes requested after the cleaning team arrives may result in additional charges and may not be possible if the team’s schedule does not allow additional work.

15. SERVICE PROVIDERS

Dani’s Cleaning may perform services through employees, cleaning professionals, teams, contractors, or other authorized personnel, subject to applicable law and Dani’s Cleaning’s operating procedures.

16. TERMINATION OF SERVICE

Dani’s Cleaning reserves the right to decline, suspend, or terminate service for reasons including:

- Repeated nonpayment;

- Abusive, threatening, discriminatory, harassing, or unsafe behavior;

- Unsafe working conditions;

- Repeated inability to access the property;

- Repeated violations of agreed policies;

- Requests for illegal activity;

- Material misrepresentation regarding the property or scope of work.

17. LIMITATION OF SERVICES

Cleaning improves the cleanliness and condition of a property but does not guarantee restoration of damaged, stained, deteriorated, permanently discolored, or worn surfaces.

Certain stains, mineral deposits, rust, mold staining, grease buildup, grout discoloration, adhesive residue, paint, construction residue, and other conditions may not be completely removable through ordinary cleaning.

18. COMMUNICATION

The Client authorizes Dani’s Cleaning to communicate regarding appointments, service updates, invoices, access questions, and customer service matters by telephone, text message, or email using the contact information provided by the Client, subject to applicable law.

19. APPLICABLE LAW

These Terms and Conditions are intended to be interpreted in accordance with applicable federal, state, and local law.

If any provision is determined to be unenforceable, the remaining provisions will continue to apply to the extent legally permitted.

20. ACCEPTANCE

By booking, authorizing, or accepting services from Dani’s Cleaning, the Client confirms that they have had the opportunity to review these Terms and Conditions and agrees to be bound by them.

DANI’S CLEANING – 24-HOUR SATISFACTION & RE-CLEAN POLICY

Dani’s Cleaning is committed to providing quality residential and commercial cleaning services.

If a client believes that an area included within the agreed scope of service was not cleaned satisfactorily, the client must notify Dani’s Cleaning within 24 hours after completion of the service.

The client should identify the specific area of concern and, when reasonably possible, provide photographs showing the issue.

Dani’s Cleaning must be given the opportunity to inspect and/or return to the property to correct any qualifying area at no additional cleaning charge.

A quality complaint does not automatically entitle the client to a discount, refund, deduction, charge reduction, or credit.

The client may not unilaterally reduce the agreed service price because of a cleaning complaint without allowing Dani’s Cleaning a reasonable opportunity to address the concern.

The re-clean guarantee applies only to services and areas included in the original agreed scope of work.

Additional services, pre-existing stains, permanent discoloration, damage, excessive buildup, inaccessible areas, or items specifically excluded from the cleaning package are not considered service deficiencies.

Complaints received more than 24 hours after service completion may be reviewed at Dani’s Cleaning’s discretion but are not covered by the 24-Hour Satisfaction Guarantee.

For commercial clients, the same policy applies unless different service-level terms are stated in a written commercial service agreement.

DANI’S CLEANING

24-HOUR SATISFACTION & RE-CLEAN POLICY

Dani’s Cleaning is committed to providing quality residential and commercial cleaning services.

We understand that occasionally an area may be missed or may not meet the Client’s reasonable expectations. When this happens, our goal is to correct the issue promptly and fairly.

1. REPORTING A QUALITY CONCERN

Any concern regarding cleaning quality must be reported to Dani’s Cleaning within 24 hours after completion of the service.

The Client should provide:

  • The property address;
  • Date of service;
  • A description of the specific area or item of concern;
  • Photographs when reasonably possible.

General statements such as “the cleaning was bad” may not provide enough information to evaluate a claim. Clients should identify the specific areas they believe require correction.

2. RIGHT TO RE-CLEAN

Dani’s Cleaning must be given a reasonable opportunity to inspect and/or return to correct any qualifying area.

If the concern relates to an item included in the agreed scope of service, Dani’s Cleaning may offer a complimentary re-clean of the affected area.

The re-clean is intended to correct the reported service issue and does not constitute an entirely new cleaning of the property.

3. NO AUTOMATIC DISCOUNT OR REFUND

Submitting a complaint, photograph, or quality concern does not automatically entitle the Client to:

  • A discount;
  • Partial payment;
  • Reduced invoice;
  • Credit;
  • Refund;
  • Charge reversal.

The Client agrees not to unilaterally reduce the agreed service price because of a cleaning complaint without first allowing Dani’s Cleaning a reasonable opportunity to evaluate and address the issue.

Any credit, refund, or price adjustment must be approved by Dani’s Cleaning, except where otherwise required by applicable law.

4. WHAT IS COVERED

The 24-Hour Re-Clean Guarantee applies only to:

  • Areas included in the original agreed cleaning scope;
  • Areas reasonably accessible during the original appointment;
  • Cleaning quality concerns reported within the required time period.

5. WHAT IS NOT COVERED

The guarantee does not apply to:

  • Areas not included in the purchased cleaning package;
  • Additional services that were not purchased;
  • Permanent stains;
  • Permanent discoloration;
  • Damage;
  • Wear and tear;
  • Excessive buildup that cannot reasonably be removed during the scheduled service;
  • Areas inaccessible during the original appointment;
  • Areas covered by clutter;
  • Post-cleaning activity by occupants, pets, contractors, employees, guests, tenants, movers, or other persons;
  • New spills, dirt, dust, debris, or damage occurring after the cleaning;
  • Conditions resulting from maintenance defects;
  • Issues reported more than 24 hours after completion, except at Dani’s Cleaning’s discretion.

6. ACCESS FOR RE-CLEAN

The Client must provide reasonable access for Dani’s Cleaning to perform the corrective service.

If the Client refuses reasonable access or does not allow Dani’s Cleaning an opportunity to correct the issue, the matter may no longer qualify for the complimentary re-clean guarantee.

7. COMMERCIAL ACCOUNTS

Commercial Clients are subject to the same general quality policy unless a separate written Service Level Agreement or Commercial Cleaning Agreement states different terms.

For recurring commercial service, Clients should notify Dani’s Cleaning promptly when an issue is discovered so the concern can be addressed before the next scheduled service whenever practicable.

CANCELLATION, RESCHEDULING & LOCKOUT POLICY

We understand that schedules change. Dani’s Cleaning asks Clients to provide reasonable notice when cancelling or rescheduling an appointment.

1. STANDARD NOTICE

Clients should provide at least 48 hours’ notice to cancel or reschedule a cleaning appointment.

Notice should be provided by an approved communication method such as telephone, text message, email, or the company’s booking system.

2. LATE CANCELLATIONS

Appointments cancelled or rescheduled with less than 48 hours’ notice may be subject to a cancellation fee.

Recommended company policy:

  • More than 48 hours before service: No cancellation fee.
  • Between 24 and 48 hours before service: Up to 50% of the scheduled service price.
  • Less than 24 hours before service: Up to 100% of the scheduled service price.

Dani’s Cleaning may waive or reduce a cancellation fee in its discretion depending on the circumstances and applicable law.

3. SAME-DAY CANCELLATION

A same-day cancellation may be charged up to the full scheduled service amount because labor time and scheduling capacity have already been reserved for the Client.

4. LOCKOUT / NO ACCESS

If the cleaning team arrives and cannot enter the property because of:

  • No answer;
  • Incorrect access code;
  • Locked door;
  • Missing key;
  • Building access restrictions;
  • Unavailable concierge;
  • Alarm issue;
  • Failure to provide entry authorization;

the appointment may be treated as a same-day cancellation.

A lockout fee of up to the full scheduled service amount may apply.

5. WAITING TIME

If access is temporarily unavailable, the cleaning team may wait for a reasonable period when scheduling permits.

Extended waiting time may result in:

  • Additional charges;
  • Reduced cleaning time;
  • Rescheduling;
  • Application of the lockout/cancellation policy.

6. DANI’S CLEANING CANCELLATIONS

If Dani’s Cleaning must cancel or reschedule because of illness, emergency, severe weather, vehicle problems, staffing problems, unsafe conditions, or other circumstances beyond reasonable control, we will make reasonable efforts to notify the Client and offer another available appointment.

7. RECURRING CLIENTS

Repeated cancellations, frequent schedule changes, or repeated lockouts may result in:

  • Loss of a recurring appointment time;
  • Change in pricing;
  • Requirement for prepayment;
  • Termination of recurring service.

8. COMMERCIAL CLIENTS

Commercial contracts may contain different cancellation or termination notice periods.

Where a signed Commercial Cleaning Agreement contains specific cancellation terms, those terms control over this general policy.
